Insulcloud S.L. (hereinafter Insulcloud) is the developer of the INSULCLOCK® SYSTEM. Insulcloud is the data controller of your personal information (including medical information) that is transmitted or stored within the INSULCLOCK® SYSTEM. These General Conditions of Use regulate the use of the INSULCLOCK® SYSTEM. Please, read carefully all the information we provide you. Using the Insulclock® device and/or the Insulclock® mobile app and using the features contained therein, implies that you have read and fully accept these Legal Notice and Terms of Use y Privacy Policy . THE INSULCLOCK® SYSTEM is a secure cloud-based system to assist in the management of diabetes, which is made up of the Insulclock® device which uses the Insulclock® mobile app to provide you with and store information regarding the use that you make of your insulin pen. All this information is presented on a web platform on which all the information collected on your smartphone is structured so that it can be consulted by your endocrine and / or diabetes educator if you give your consent.   THE INSULCLOCK® SYSTEM IS NOT DESIGNED TO PAUTATE MEDICATION OR MAKE RECOMMENDATIONS ON HOW TO MANAGE INSULIN OR ITS POSOLOGY. USERS MUST NOTE THAT THE INSULCLOCK® SYSTEM IS SIMPLY A MANAGEMENT AND STORAGE SERVICE OF INFORMATION AND IS NOT PURPOSE-TO-REPLACEMENT, SUBSTITUTE OR COMPLEMENT THE ADVICE OF A HEALTH PROFESSIONAL.   These Terms of Use do not exclude the possibility that certain Services of the Insulclock® mobile application, due to their particular characteristics, may be subject, in addition to the General Conditions of Use, to their own particular conditions of use (hereinafter the Special Conditions). Access and download of the Insulclock® mobile application is free, except for the cost of connection through the telecommunications network provided by the access provider contracted by users. We recommend that you visit our website often to check the services it includes, as they may change. However, in the event that the modification significantly affects the contracted services, we will inform you appropriately. The Insulclock® device converts the disposable insulin pen into a smart pen, taking advantage of the time of insulin administration, automating the introduction of data and interconnection between the drug setting and the digital world of smartphones. Via Bluetooth, the Insulclock® device transfers the information to your smartphone and it is stored in the Insulclock® mobile app and on our servers. Please, read the Instruction Manual for your Insulclock® device carefully. You may use the Insulclock® mobile app even if you do not have the Insulclock® device, although, in this case, you will lose the data entry automation functions in your diabetic diary regarding the type of insulin, the amount of insulin injected, the time of insulin injection and the measurement of the ambient temperature at which the insulin pen has been exposed. The Insulclock® mobile app allows you to enter all this data manually, as well as:

• Manually enter your glucose levels or by embing your data directly from the Healtkit (for the iOS version of the Insulclock® mobile app) or obtaining this data from compatible glucometers with BLE or NFC connectivity. Check out the list of compatible glucometers in the DEVICES section of the Insulclock® mobile application
• Manually enter your physical activity sessions or by embing your data directly from the Healtkit (for iOS version of the Insulclock® mobile app) or GoogleFit (for the Android version of the Insulclock® mobile app)
• Add notes manually in your Insulclock® mobile app diabetic diary.
• Add food pics, which will be recorded in your diabetic diary of your Insulclock® mobile app.
• You can set alarms, injection reminders, which will alert you on your smartphone at the time you determine you should inject; it will even notify you when an injection that you had previously scheduled has been registered in the application.
• You may establish TUTORS (family member, doctor or friend) to accompany and help you improving the adherence to your treatment.
• You can access the contents of the blog of our website or to our YouTube channel in which we offer you information on diabetes treatment, dibetological training, healthy life, exercise and nutrition and about the latest news offered by Insulcloud.
• You can generate reports in Pdf. or Excel format to send them to the person you choose. These reports will contain the information you record in the diabetic diary of your Insulclock® mobile app.

  The INSULCLOCK® SYSTEM is capable of:

• Monitor treatment administration (when, how much and what type of insulin is injected).
• Save glucose levels (currently manually or by embedding Healthkit or from compatible glucometres).
• Watch over for the preservation of insulin properties, knowing at what temperature your Insulclock® device if is properly placed in your insulin pen.
• Generate alarms to avoid errors, forgetfulness and double injections. These alarms are configured from the Insulclock mobile app® and, if configured by following the manual of your Insulclock device®, will also sound on this.
• Filling out your diabetic diary of the Insulclock® mobile application automatically and with total fidelity, recording insulin doses, glucose levels, notes and photos of meals.
• Generate Excel and Pdf reports with the medical history of the administration of the drug that has been previously recorded in the diabetic diary of the Insulclock® mobile application.
• Involve a tutor so that he is promptly informed of our evolution
• Establish direct communication with our endocrine physician and/or diabetic educator, allowing you to access the data in real time.

All these services and features of the INSULCLOCK® SYSTEM (Insulclock® mobile application and Insulclock® device) are generally described. Check the services specific to the version of your mobile app in ourwebsite. Insulcloud wants to let you know that the Insulclock® mobile app is addressed to all audiences. Minors who intend to use this mobile application must have the prior consent of their parents, guardians or legal representatives, being the only ones responsible for the acts performed by the minors in their care.  

• Registration and Passwords

Because the Insulclock® mobile app will manage personal data of a medical and biometric nature among others, to guarantee you a correct protection of your personal data, you must register as a user in order to make use of this application, with a valid email address and password. Please read carefully everything in this document regarding our Privacy Policy. Once you have registered as a user of the INSULCLOCK® SYSTEM (Insulclock® mobile application and/or Insulclock® device) you will receive a confirmation email to the email you have provided. Make sure you have provided us with a correct email. That confirmation email will ask you to confirm your acceptance of these GENERAL TERMS AND CONDITIONS OF USE and our PRIVACY POLICY. Do not disclose your password to any third party and modify it periodically. In the event that you forget your password, we will provide you with a recovery mechanism, through which we will send you an access password, generated randomly and automatically by our system, to the mail you provided to us. Make sure that the email address you provide to us is spelled appropriately. Once you have logged into your account with the password we have provided, we recommend that you set a new one that is easy for you to remember. Users who have a Facebook or Google profile will be able to register in our mobile application to register using the social media plugin, through the technology of single registration technology (SSO). • Profile Creation

The Insulclock® mobile app gives you the possibility to create a profile in which you can add a series of data: photo, name, e-mail, phone, weight, height, sex, date of birth, type of diabetes and debut year. You may or may not provide us with this data, without the completion of these fields being mandatory, except for the mail field, which is filled in by default as it is the one associated with your user account. Please read our Privacy Policy.  

• Alarm Settings

The Insulclock® mobile app gives you the ability to set a series of alarms or reminders that alert you when to take insulin. You are solely responsible for your use of this section of the Insulclock® mobile app. If you have any questions about the times of day and the frequency when insulin should be injected, consult your doctor. If you have an Insulclock® device, carefully follow the user manual for the correct alarm settings on your device Insulclock®, so that the injection alarms-reminders alert you to both your smartphone and your Insulclock® device.  

• Choice and appointment of caregivers

The INSULCLOCK® SYSTEM, through the Insulclock® mobile application, also keeps the person appointing the diabetic patient informed, by establishing a TUTOR and/or FAMILY (an ALLLY) in diabetes. The caregiver is the person who will be informed (upon acceptance of the user of the Insulclock® mobile application and that the caregiver himself accepts his designation) of all the parameters and data collected by the INSULCLOCK® SYSTEM, notifying if he/she has taken the insulin, when he/she has taken it, what dose, what type of insulin, storage temperatures, etc. Issuing alarms and emails to alert the guardian of forgetfulness, inadequate doses, error with insulin types, under or over-temperature storage, etc. This feature is specially designed for children, elderly and dependents. In this way, patients can be monitored by their parents (in the case of children) or by their children or caregivers (in the case of elderly people). The user of the Insulclock® mobile app is free and voluntarily decides which person he/she designates and invites as a caregiver by providing caregiver’s data (photo, name, name and surname, kinship or relationship, telephone, e-mail). In addition, the user may select the permissions that he/she grants to give to caregiver: allow them to view information about the patient himself, receive injection alerts, and allow the him/herself to create the user's alarms. The user is solely responsible for any liability that may arise for the appointment of the caregiver. Once the caregiver is appointed, he/she will be notified to accept the designation as such. The caregiver will be adequately informed about the implications of acting as a caregiver as well as the origin of their personal data.  

• Devices

In this section of the Insulclock® mobile app you will see the Insulclock® devices and glucometers you have associated with your app. Follow the user manual included in the box of your Insulclock® device for syncing your Insulclock® device to your Insulclock® mobile app. Please, note that the Insulclock® mobile app may receive information from some Bluetooth-enabled glucose readers and meters, as well as other apps such as GoogleFit or HealthKit. Insulcloud is not responsible for your connection with these third-party products or for your decision to upload data from these third-party products to your INSULCLOCK® SYSTEM account.      2. Intellectual Property Rights Insulclock^© all rights reserved. The content of the INSULCLOCK® SYSTEM, including but not limited to the INSULCLOCK® SYSTEM (Insulclock® device and the Insulclock® mobile application), texts, images, photographs, drawings, logo designs, graphics, brands, icons, combinations of colors or any other element, its structure and design, the selection and presentation of the materials included in it and the firmware and software, links and other audiovisual and sound content, as well as its graphic design and source codes necessary to its operation, access and use are protected by the rights of Industrial and Intellectual Property, owned by Insulcloud or third parties, without being understood to be transferred the exploitation rights over them beyond what is strictly necessary for the proper use of the INSULCLOCK® SYSTEM. In particular, reproduction, transformation, distribution, public communication, making available to the public and, in general, any other form of exploitation, regardless of the procedure used, of all or part of the contents of the INSULCLOCK® system, as well as its design and the selection and presentation of the materials included in it and the procedure used to do so are prohibited.
